1. Acknowledgment
These Terms and Conditions constitute an End-User License Agreement ("EULA") between you and Neil Richards, trading as Coastal Bytes ("we," "us," or "our"), not with Apple Inc. ("Apple"). Coastal Bytes is solely responsible for the Study Pilot series of applications (each an "App"), including Study Pilot: Digital Technology and any future subject editions, and their content.
This EULA complies with the App Store Terms of Service and Apple Media Services Terms and Conditions. It applies to all apps published under the Study Pilot name.
2. Scope of License
We grant you a non-transferable, non-exclusive license to use each Study Pilot app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Maintenance and Support
Coastal Bytes is solely responsible for providing any maintenance and support services for Study Pilot apps, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to any Study Pilot app.
4. Warranty
Coastal Bytes is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you.
To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
5. Product Claims
You acknowledge that Coastal Bytes, not Apple, is responsible for addressing any claims of the end-user or any third party relating to any Study Pilot app or the end-user's possession and/or use of that App, including, but not limited to:
(i) product liability claims;
(ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and
(iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Coastal Bytes, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
By using any Study Pilot app, you represent and warrant that:
(i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. User Data and Privacy
Your use of Study Pilot apps is also governed by our Privacy Policy. Study Pilot apps do not require an account, do not use cloud syncing, and store all data locally on your device. We do not collect, store, or have access to any user data.
9. Exam Board Disclaimer
Study Pilot is a series of unofficial revision and quiz tools. No Study Pilot app is affiliated with, endorsed by, or connected to WJEC (Welsh Joint Education Committee) or any other examination board.
All content within each App has been created independently to support students in their studies. Study Pilot apps should be used alongside official course materials and resources provided by your school or college. Coastal Bytes makes no guarantee that the content within any Study Pilot app covers the entirety of any examination specification, and accepts no responsibility for examination outcomes.
10. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App (e.g., you must ensure your use of the App is not in violation of your wireless data service agreement).
11. Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.
12. Governing Law
This agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales.
